Some States Are Cutting Poor Dads A Deal On Unpaid Child Support

child support shacklesMany states have opted for oppression when it comes down to child support debt. A few wiser minds are prevailing in a few places. When the state of Maryland wanted to reach dads who were behind on their child support payments, it started in the boarded-up blocks of West Baltimore, in neighborhoods marked by drugs, violence and unemployment.

In just four zip code areas, the state identified 4,642 people who owed more than $30 million in back child support. Most of that was “state-owed,” meaning that rather than going to the child through the custodial parent, it’s supposed to reimburse taxpayers for welfare paid to the child’s mother.

This is a source of great resentment for many men, who say they want their money to go to their children. But most who owe it can’t pay anyway, as they earn less than $10,000 a year.

slavery to children“So even if we use taxpayer dollars to chase ’em down, and we catch ’em, right, and we go into their pockets, there’s nothing in there,” says Joe Jones of Baltimore’s Center for Urban Families.

Are they deadbeat?

Joseph DiPrimio, head of Maryland’s child support enforcement office, doesn’t like that expression. “I think that’s vulgar. I don’t use it,” he says. DiPrimio prefers “dead broke.”

“We’re talking about individuals that are economically challenged, they’re underemployed, but they want to do the right thing,” he says.

Unpaid child support in the U.S. has climbed to $113 billion, and enforcement agencies have given up on collecting much of it. They say too many men simply don’t have the money.

What’s more, research shows that high child-support debt can leave parents feeling so hopeless that they give up trying to pay it.

Breaking Through The Distrust

And sting operations to round up parents who owed child support have happened all over the country, including Baltimore. In a typical ruse, agencies have sent fake letters telling parents they won tickets to a football bowl game, for instance — but when they showed up to collect, they were arrested instead.

father-sonTo break through years of distrust, Maryland sent letters to parents with the logo of the Center for Urban Families, a nonprofit in West Baltimore that provides job training and other help to poor families.

They made this offer: If the parent takes the center’s month-long employment training course and lands a job, the state will forgive 10 percent of his or her child support debt. If they complete a Responsible Fatherhood program, the state will write off another 15 percent. One of the first persons to sign up was a mother, though the vast majority of noncustodial parents are men.

In a separate “debt compromise” program, Maryland will also write off 50 percent of a parent’s child support debt if they maintain monthly payments for a year.

fathersrightsResponse has been slow. In two years, slightly more than 100 parents have signed on. Many of them attend fatherhood meetings like one held on a recent Wednesday night. Two dozen men — 20-something to middle age, in sweats and in suits — sit in a large square.

Some complain their exes won’t let them see their child if they haven’t paid child support. Others don’t understand why it doesn’t count as support when they take their kids out to eat, or buy them clothes — or say they would do those sorts of things for their kids if their child support obligation wasn’t so heavy.

“You telling me no matter what, I gotta pay. But I can’t get a job to work to save my soul,” he says.

Group leader Eddie White cuts no slack. “If you know you got a criminal record, sure it’s gonna be hard for you to get a job. But it don’t mean you can’t work,” White says.

A big part of this class is also educational. White asks the men what a person who is paying child support should do if he gets laid off or loses his job.

“There you go, that’s the word. Immediately,” White says. “Immediately ask the court for an adjustment.”

Other Approaches To Debt Relief

Maryland’s program is part of a larger effort to keep impoverished parents from racking up child support debt in the first place.

baby moneySome states are trying to speed up the cumbersome process of adjusting an order when a parent loses a job. Ohio has experimented with sending simple reminders — by phone, mail or text — to parents who need to send in monthly payments. Texas has reached out to newly incarcerated parents, to let them know they can apply to have their payments reduced while in prison — something not all states allow.

“We sent out a teaser postcard trying to combat the ostrich effect,” says Emily Schmidt, a research analyst with the U.S. Administration for Children and Families, who helped with the Texas effort.

Schmidt says there was concern that someone going through the emotional transition of incarceration wouldn’t likely be thinking about child support, and may not even open a letter from the state. So they printed the postcard on blue paper to stand out, and, taking a cue from marketers, it said, “Four easy steps to lowering your child support.”

After 100 days, the response rate among parents was up 11 percent, “a very low-cost intervention for a fairly dramatic effect,” Schmidt says.

barack obamaThe Obama administration wants to “right size” child support orders from the start, and has proposed regulations to make sure they are set according to what parents actually earn. Officials say some jurisdictions base orders on a full-time minimum wage, even if a parent earns far less. They say this can backfire, leaving so little money after a parent’s wages are garnished that he or she quits and works underground instead.

The White House’s proposals also would provide more job training for parents with child support debt — something Ron Haskins of the Brookings Institution says is a good investment.

“More fathers will get a job, more fathers will have earnings, and more fathers will use those earnings to pay child support,” he says.

So far, that’s what’s happened in Baltimore. The numbers are small. But the amount of child support that’s been paid is more than double the amount of debt written off.

Maryland wants to expand its child support debt forgiveness program, hoping to help more parents to pay what they can.

They may even fool themselves by equating the expense of court with love for their kids. Supporting a fascist terrorist system to achieve justice is insanity of the highest order. Some have fallen into this trap in the past, and now see the light. Most are still lost in the darkness of state propaganda.

Today, the founding documents of the United States are sometimes given lip service, but are commonly violated by modern government officials. Just as foreign wars are profitable for war industries, war within families is profitable for the divorce industrial complex. This industrial complex consists of judges, courts, lawyers, psychologists, social workers, “child support” workers, and all who assist in separating parents who have committed no crime from their children.

Neither industrial complex have use for peaceful resolutions. They thrive from trickery and slander.

VIOLATIONS OF CIVIL AND CONSTITUTIONAL RIGHTS:

1) Denial of First Amendment Freedoms of Religion and Speech – Parents cannot train up their children according to their beliefs when stripped of parental authority.

2) Denial of First Amendment Right to Petition for Redress of Grievances – Parents, mostly fathers, are denied justice in family courts – their petitions are denied or dismissed.

3) Kidnapping – State “family” court judges steal children from fit, law-abiding parents, perpetuating custody battles.

4) Denial of Fourth Amendment Right to Privacy – Unsubstantiated accusations result in invasion of homes and stealing of children by police or child protective services without probable cause; judges routinely order psych evaluations which invade and probe every detail of private family life of law-abiding parents. Parties who come to court to address legal issues are diverted into a wilderness of psychological evaluations because judges refuse to do their job: enforce the constitutional right to parent, further draining family assets.

5) Denial of Fifth and Fourteenth Amendment Rights to Due Process of Law – These include: denial of the right to free counsel for poor defendants, denial of the right to take depositions, lack of evidenciary hearings, lack of notice, and improper standard of proof – with defendants being presumed guilty and being sentenced, like criminals, to loss of the fundamental constitutional right to be a parent.

6) Denial of the Sixth Amendment Right to a Speedy and Public Trial – “Temporary” pendente lite orders in secretive unrecorded hearings usually become permanent orders. Justice delayed is justice denied. Fathers are treated as guilty in either or both criminal and “civil” court upon mere accusation, and are in effect sentenced to loss of the fundamental right to parenthood in civil court even if criminal cases are dismissed.

7) Denial of the Seventh Amendment Right to Trial by Jury – Heartless, treasonous judges make decisions to sever loving parent/child relationships which no jury would allow, which perpetuates continual litigation and profits for the divorce industry.

8) Denial of Thirteenth Amendment Prohibition Against Slavery and Involuntary Servitude – Usually fathers are enslaved as non-custodial parents and forced to pay extortion (so-called “child support”) or risk being thrown into debtors’ prison.

9) False Imprisonment – Fathers are typically arrested first in domestic disputes upon mere accusation. Usually fathers are thrown into debtors’ prisons when they do not or are unable to comply with the illegal extortion/”child support” orders.

10) Denial of Fourteenth Amendment Right to Equal Protection of the Laws – Mothers initiate most divorces and are “awarded” sole custody in the vast majority of contested cases even though both parents are equally fit and loving parents, resulting in state sanctioned gender discrimination and child abuse – stealing one half of the child’s world.

11) Denial of Fourteenth Amendment Liberty Interest in the Family – Numerous U.S. Supreme Court rulings have well-established the fundamental liberty interest in the family and the constitutional right to be a parent. Yet, treasonous family court judges daily and routinely ignore and violate the U.S. Constitution and their own state constitutions, and violate their oath of office to uphold those constitutions.

12) Fraud upon family courts – Judges and lawyers of the multi-billion dollar divorce industry increase the amount of custody and family law litigation in contradiction of its alleged purpose – to strengthen and preserve families, by trampling on the rights of U.S. Citizens.

Then, under the false pretense, a created need for “child support” caused an unequal custody order, the same renegade, tyrannical judges issue extortion (“child support”) orders against these parents. They even routinely jail parents who do not or are unable to obey their extortion demands in debtors’ prisons of involuntary servitude. This false imprisonment is nothing less than slavery.

B. EXTORTION against a fit parent, necessary ONLY because of the illegal, unconstitutional, forced unequal custody order, is called “CHILD SUPPORT “.

C. INVASION OF PRIVACY when no crime has been alleged is called a “PSYCHOLOGICAL EVALUATION”.

One Way To Handle A Court

When you go into court what do you find? Here are some general things to consider.

deceptionThe judge sits above everyone else. The judge, prosecutors and accused reside in a fenced area. Today, this is NOT a court room, this is the judge’s or magistrate’s chambers. Judges chambers are wherever they set them up to be, not just the office in the back. Court rooms would be for common law which almost never exists today. This is part of the deception. A “magistrate” is not a judge, who sees you in their chambers, where they can do what ever they want, without the constitution, your natural rights, etc. Why is this corporate representative siting in a raised position? Simply put, from childhood you are taught to look up to “authority”. It’s a pretty intimidating environment designed to engender your respect and obedience. They use words in double meanings just as their environment is also part of an act, a stage. Their words are deceptions as are their practices. In reality, the trial or hearing should be held in a sunken area like a surgeons theater where people look down on the judge and oversee the process.

Always insist first and foremost to be “on the record in a judicial hearing”. This removes the magistrate from doing anything they want with you. If you feel forced into accepting the judges chambers, then you can inform them you are in judges chambers, all parties are equals, they have no political jurisdiction, you are a sovereign spirit present by special appearance and there is no contract. More importantly, when you enter the court room and they call your name, loudly proclaim that everyone present is fired and you are a sovereign spirit there by special appearance. Repeat that at any time. If the magistrate threatens (tries to extort your submission), remind them they are fired and you are in judges chambers instead of a professed court room! A judge can not practice law from the bench. They can’t assign you council or otherwise. Remind them they are fired and you have not and will not give them authority to make and legal/lawful determinations for you. You do not consent. Once presented with their offer of contract, you can state your willingness to accept their offer and negotiate a settlement with them. Asserting your authority ends the controversy and the professed judge is now only working out the settlement. The prosecutor will deal with terms and you can agree on terms. They must provide proof of the contract that obligates you to any of the statutes, including any ‘crimes’ that are listed. There is no contract, nor is there a bond for the transaction.

The main purpose of a professed judge or magistrate is to moderate the conflict between you and the prosecution of the government. They will present you with their shopping cart of ‘charges’ or items on sale. You will notice the dollar sign, dollar amounts attached. You are in a martial law tribunal. This is martial law and you are presumed guilty. This is the summary judgement which holds the charges and the plea in one. It is pure, unadulterated fraud. They have no law, no authority, no contract, only deceptions designed to cultivate your submissive acceptance that what is going on is authority over you. This is a common corporate scam of all modern government designed to make them money.

If you are in a trial situation and given an unfavorable verdict, you are being given an offer of a contract. Promptly, loudly, clearly and politely refuse to accept it. Keep refusing to accept until you are asked what you will accept, then state “dismissal of all charges with extreme prejudice”. You are in a martial law court where the verdict and sentence are an offer. Don’t accept it and don’t settle for less.

Do not ever hire an attorney and if you are assigned one, fire that professed attorney. If you are in court, fire them immediately. The attorney works for the court and are officers of the court. They are the tools of your bondage to a fraudulent system.

Common Law and Full Disclosure

Common Law, which is said to apply to all living souls is that living beings are free to do what we please, as long as we do not infringe on the life, liberty, property, or rights of another. Governments are not allowed by common law to prosecute or fine us for victimless crimes. Statute laws have arisen for this purpose, but their power is limited by common sense and by the resolve of those who would stand up for their natural rights.

A living being can be fined only if he has signed and breached a contract. Under common law, however, a contract must be entered into with full disclosure: knowingly, voluntarily and intentionally or the contract is unenforceable. Remember that one of the requirements of a contract is full disclosure. Government departments and agencies are aware of this and circumvent it by intimidating us into signing agreements that are meant to void common law rights. This one law which takes all real crime into account has now been replaced by over sixty million statutes in the effort to compel you to do something. Law cannot compel performance, but the statute of government pretends to. These 60,000,000 statutes are all based on the idea of ‘commerce.’ How many contracts are you involved with where you have real disclosure that isn’t manipulated by a ‘higher power?’

Web of Inquisitional U.S. Law Creating Criminals

we the peopleFor decades, Washington D.C. has been adding to the number of federal laws and regulations that carry criminal penalties. Now the number is so high, no one is actually sure how many there are. Experts say practically anyone could be convicted of some sort of federal crime. And it’s all too easy for anyone to violate one of these laws and never know it. Congress has made it dangerous just to be alive in America, never mind whether you are guilty or not. Like federal child support laws, it’s all a matter of inquisition. Common law is dead.

The truth is that anyone can fall prey to overcriminalization. Civil rights have become secondary to the Rule of Law and I don’t mean Common Law. This law certainly isn’t your grandfathers law. [protected] Legal misadventures happened to racing legend Bobby Unser beginning in 1996. Unser went snowmobiling in the Rio Grande National Forest on the border of New Mexico and Colorado.

He and a friend got caught in a blizzard and were stranded for two days and two nights. They barely escaped with their lives. But that was only the beginning of his ordeal. “Bottom line: Don’t trust any government agency,” he warned. “Stand as clear from them as you can. Stay away from them because they’re not there for your good.”

Unser found himself in the middle of a fight with the U.S. Forest Service, facing a possible $5,000 fine and six months in jail for violating The Wilderness Act. The agency accused him of illegally snowmobiling on federally protected land known as “wilderness area.” The racing champ claimed that even if he was in the wilderness area, it was only when he was lost in the snowstorm. With money in the bank and the idea of principle, Unser decided to fight the charge in court.

“Well, I estimate that we probably spent around $300,000, maybe $350,000 would be my guess,” Unser said. As for the government, they spent millions of dollars in their efforts for prosecute Unser. “At the time we went to court, they’d already spent up somewhere around a million dollars. What – it’s the taxpayers money. They didn’t really care how much it cost,” he said.

In the end, he lost and paid a $75 fine. Now the three-time Indy 500 winner has another title to add to his record: He’s been convicted of a federal misdemeanor for getting lost in the wilderness.

Like many others, Unser blames Congress and the men that run it for the growing number of federal laws.

But it’s not just lawmakers who are at fault. Federal agencies not only enforce the laws, but write their own regulations which also carry criminal penalties. With government involved in everything from the environment to employment to health, anyone can easily get caught in the web of federal laws. The numbers prove it. Between 2000 and 2010, close to 800,000 people were sentenced for federal crimes.

Representative Louie Gohmert, Republican – Texas is among a few lawmakers on Capitol Hill sounding the alarm about the disturbing phenomenon, saying that Congress should re-think stiff penalties on simple accounting errors when filing taxes. In the past 20 or 30 years the number of people in jails and prisons in American has gone up almost tenfold because every time you turn around there are new laws.

One solution is for the House Judiciary Committee to oversee any new regulation that carries a criminal penalty, but this may be akin to having another fox to watch the hen house. The attitude behind the penalties is that Congress wants to appear to be tough on crime, including doubling up where state law is sufficient. It wastes money and doesn’t reduce crime. Orwell’s classic book “1984” states the case where fear is predominant and the violation of federal law is likely. There isn’t enough public awareness or outrage! Sadly, this is already because of fear.

Is Obama a hypocrite or merely insouciant? Or is he an idiot?

China FlagAccording to news reports Obama’s White House meeting on Valentine’s day with China’s Vice President, Xi Jinping, provided an opportunity for Obama to raise “a sensitive human rights issue with the Chinese leader-in-waiting.” The brave and forthright Obama didn’t let etiquette or decorum get in his way. Afterwards, Obama declared that Washington would “continue to emphasize what we believe is the importance of realizing the aspirations and rights of all people.”

Think about that for a minute. Washington is now in the second decade of murdering Muslim men, women, and children in six countries. Washington is so concerned with human rights that it drops bombs on schools, hospitals, weddings and funerals, all in order to uphold the human rights of Muslim people. You see, bombing liberates Muslim women from having to wear the burka and from male domination.

One hundred thousand, or one million, dead Iraqis, four million displaced Iraqis, a country with destroyed infrastructure, and entire cities, such as Fallujah, bombed and burnt with white phosphorus into cinders is the proper way to show concern for human rights. Ditto for Afghanistan. And Libya.

In Pakistan, Yemen, and Somalia Washington’s drones bring human rights to the people.

Abu Ghraib, Guantanamo, and secret CIA prison sites are other places to which Washington brings human rights. Obama, who has the power to murder American citizens without due process of law, is too powerless to close Guantanamo Prison.

He is powerless to prevent himself from supplying Israel with weapons with which to murder Palestinians and Lebanese citizens to whom Obama brings human rights by vetoing every UN resolution passed against Israel for its crimes against humanity.

Instead of following Washington’s human rights lead, the evil Chinese invest in other countries, buy things from them, and sell them goods.

Has any foreign dignitary ever raised “a sensitive human rights issue” with Obama or his predecessor? How is the world so deranged that Washington can murder innocents for years on end and still profess to be the world’s defender of human rights?

How many people has China bombed, droned, and sanctioned into non-existence in the 21st century?

Will Syria and Iran be the next victims of Washington’s concern for human rights?

Nothing better illustrates the total unreality of life in the West than the fact that the entire Western world did not break out in riotous laughter over Obama’s expression of his human rights concern over China’s behavior.

Washington’s concern with human rights does not extend as far as airport security where little girls and grandmothers are sexually groped. Antiwar activists have their homes invaded, their personal possessions carried off, and a grand jury is summoned to frame them up on some terrorist charge. US soldier Bradley Manning is held for two years in violation of the US Constitution while the human rights government concocts fabricated charges to punish him for revealing a US war crime. WikiLeaks’ Julian Assange is harassed endlessly with the goal of bringing him into the human rights clutches of Washington. Critics of Washington’s inhumane policies are monitored and spied upon.

Washington is the worst violator of human rights in our era, and Washington has only begun. Who will liberate Americans from Washington’s clutches?

With all this in context, millions of American citizens no longer have the same human rights as the rest of the nation. Your rights have been steadily eroded since the 1990’s. An assortment of Republican and Democrat Presidents have seen to this through the unconstitutional federal Bradley Amendment as well. You are continuing to lose your ‘human rights,’ as you sleep, hoping against all hope for a better tomorrow, without doing a thing.

Human Rights and Child Support in the U.S.

The concept of child support was originally designed to be dynamic and flexible, going up and down as parental income changed. This is no longer the case. The Bradley Amendment has become an anathema to human rights propogated by the U.S. government, presented as responsible parenting and care for children. The reality is that the system promotes fear and the trampling down of human rights on multiple levels.

Child Support has become a national battleground for human rights that is being ignored in the United States. The United States cannot stand as a champion of human rights. In the case of the family and parents, non-custodial parents have become an oppressed and distressed object of  political disdain, designed for political support and convenience through the division of families, often augmented by controlling maternal sociopaths. 

Non-custodial parents have become social targets of envy and jealousy. The social, financial envy and oppression of parents has become big business to government and business alike.  Coupled with the criminalization of poverty in the United States, oppressed and distressed parents that become unemployed or have life-changing events fall into a government-ordained economic and social trap as the wealthy of the nation look away or promote as a device for their own personal satisfaction. There is a grass-roots movement to change the oppression of human rights in America. Someone does care and has been taking action, whether you approve of their methods or not.
