A Different Look on Law: Why Punish People for “Speeding”?

speed trapWhy should anyone be subject to punishment merely for driving “x” speed? Is it not of a piece with punishing someone for merely consuming alcohol?

The justification usually given is that “speeding” might cause harm.

Ok, sure. The same is true about drinking beer. Someone (generally) might drink beer and beat his wife. But we do not presume (for now) that everyone who drinks beer willbeat his wife – and thus, drinking beer must be forbidden. And violators of this policy punished.

What about punishing (hold onto that thought) people when – and only if – they actually do cause harm? Not before – and not because they might. Or because “someone” else has.

It’s a crazy idea, I realize.

Imagine: You’d only have to sweat cops or face a judge if you (and not some other person you never even met) could plausibly be charged with having caused harm to an actual victim or damaged the actual property of someone else. Mark that. A flesh and blood victim would have to be presented.

And it would be the obligation of the courts to prove that harm was done to establish guilt before requiring restitution (much preferable to punishing people, which smacks of house training a puppy).

There would be an end to this business of people being put through the system who’ve harmed no one. Who are punished for manufactured offenses against the state.

Can the state be a victim?

Is the Tooth Fairy real?

It’s absurd – and vicious.

Do you feel guilty of wrongdoing when pulled over by a cop for not wearing a seatbelt? Who have you harmed? What justification – other than “it’s the law” – is there for punishing you?

How about driving faster than an arbitrary number plastered on a sign? You get pulled out from a crowd of others doing the same thing; none of you harming anyone or even plausibly threatening it. It’s merely your unlucky day. Your time to pay.

As the cop slides in behind you, does your internal monologue run along the lines of, “well, yeah… I did a bad thing… I deserve this.”

Or do you feel disgust, anger – and resentment?

Of course.

This has serious implications.

Laws without a moral basis are just arbitrary rules. They have no moral force – and that makes people subjected to them feel abused. Which they have been. Meanwhile, it also makes it more difficult to deal with the relatively small number of people in society who actually do cause harm to others. If you doubt this, take a drive into a “bad” neighborhood; where are all the cops?

Remember the “Drive 55″ idiocy that lasted from about 1974 to 1995? Overnight – and for the next 20 years – it became illegal “speeding” to drive 70 when the day before it had been legal to do that and – presumably (being legal) “safe.” How does it become “unsafe” to drive 70 on the same road today that it was (apparently) “safe” to drive 70 on yesterday?

What was it Bob Dooole used to say? You know it, I know it, the American people know it.

Millions of people were simply ripped off – had their money stolen from them under color of law.

The contempt and corruption this bred is incalculable. It festers to this day. Because while “Drive 55″ is history, the same rigmarole exists on secondary roads. Every day, thousands of people are pulled over and literally robbed. Issued what amount to ransom notes – state-sanctioned extortion – for driving at reasonable and prudent velocities that happen to have been codified as illegal “speeding.” The fact that virtually every one “speeds” – this includes cops – is the clearest, most inarguable proof that the laws are absurd. And their enforcement a sort of low-rent sadism that also happens to be very profitable.

What’s the solution?

speed trap in TexasSpeed limits as such ought to be thrown in the woods. They are arbitrary, morally indefensible – and most of all, one-size-fits-all.

People are individuals and some people are better at certain things than others. This includes driving. Tony Stewart is a better driver than I am. But I am a much better driver than my mother-in-law. Why should Tony Stewart be dumbed-down to my level?

And why should I be dumbed-down to my mother-in-law’s?

Imposing arbitrary, one-size-fits-all limits on anyone for anything is by definition unfair.

Arbitrary man-made “speeding” laws based on a dumbed-down/least-common-denominator standard amount to ugly and stupid people punishing the good-looking and smart ones.

The people who support such laws support anticipatory and pre-emptive punishment. That is, laws that assume something bad will happen if “x” is not punished.

And which punish the “offender” as if something bad had actually happened.

Even if it never did.

Innocence of having caused harm is (currently) no defense. It’s not necessary for the government to produce a victim. All that’s necessary, legally speaking, is for the state to prove that “the law” was violated.

Comrade Stalin would approve.

Cue the keening wail that, absent speed limits, people will drive excessively fast and lose control.

Yet they do exactly that already – speed limits notwithstanding. Just as people still drive soused (and senile, too).

The difference between the harm-caused/actual victim approach – and the “it’s the law” approach – is that the former only holds those who actually do lose control – for whatever reason – accountable. Everyone else is free to go about their business. To live as adults – rather than be treated as presumptively unintelligent children.

speed trap victimSpeed advisories would be fine. For example a sign letting you know that there is a sharp curve ahead and maybe reducing speed would be good. Drivers unfamiliar with that road – and never having driven that curve before – may find this information helpful. But why should the local who is familiar with that road – and who drives that curve everyday – be subject to punishment for taking the curve at a higher speed?

Assuming, of course, that he does so competently, without causing harm to anyone in the process?

That was once the American Way. Not “do as you please” – the dishonest, demagogic bleat of Clovers. But rather, do as you please… so long as you don’t cause harm to others.

The false choice offered by Clovers is total control in exchange for total safety – the “risk free” world. But this is a quixotic quest that can never end, because risk cannot be removed from this life. We all get sick – and die eventually. Entropy happens.

What can be excised, however, is the risk to our liberties, our peace of mind, our enjoyment of life – presented by random and arbitrary interference and punishments based not on what we’ve done, but on what “someone” might do.

Father’s Day – Money Is The Measure, Not Freedom

dad-and-sonMen have been honestly caring for their children from the beginnings of civilization. Some have not, including mothers. It has always been that way. We don’t live in a perfect world. Enter the modern state in all its’ wisdom, where all people are expected to tolerate a state-controlled legalized extortion racket because children are the future – but mostly for benefit of the state. The state even routinely combs through bank records in the eternal vanity of finding a few stray bucks from those that dare to evade child support collection. It’s an old game whose influence has steadily increased since the free love movement, when rancorous feminists began burning their bras and politicians saw the political cache they could achieve through social manipulation. As a result, the real role of fatherhood and the definition of a family has been continually cheapened.

stress single motherIn the corporation known as the United States, the system routinely oppresses fathers, while offering poverty support to single and divorced mothers (and some fathers). They have also been oppressing the taxpayer as well, hoping and pretending to bring in more than they spend, even as they send state corporations double their child support collections. Only the light-headed politicians of the United States would think to do such a thing. Of course, these are the same men and women that fund operations as the “policeman of world” while playing “Uncle Sugar” to the world. They even continue to send China a regular stipend because of its’ poverty, while running a burgeoning deficit that the children of the future are expected to pay. This is obviously unsustainable, despite the fact that they indirectly operate the printing presses that prop up the reserve currency of the world. In fact, this is the only reason that the lawmakers that rule “Uncle Sugar” can continue to operate as they have. The nation as it stands is living on borrowed time.

Since money is the measure in the propaganda that is cast about, you’ll find that fatherhood is measured the same way. This is no surprise in a nation mesmerized by the illusion of wealth. Social scientists at Johns Hopkins have decided that low income fathers purchase a relationship with their children.

baby money“They want their kids to look down at their feet and say, ‘My dad cares about me because he bought me these shoes,’” says a co-author of the study in a press statement. “We need to respect what these guys are doing, linking love and provision in a way that’s meaningful to the child. The child support system weakens the child/father bond by separating the act of love from the act of providing.”

Yet, the child support system plugs along mercilessly despite a nation of earners that has not truly recovered from the economic debacle that eclipsed in 2008. Untold millions have been crushed, merely grist for the mill of poor governance. Republicans claim that we must find a way to be fiscally responsible, while supporting the current child support system that imprisons the nation. This is a lie pressed to ignorant people. They simply support the status quo with the illusion of conservative values. Their buddies are merely more “progressive.” Meanwhile, the men that give their blind consent can choose to pretend they are purchasing the adoration of their children, as these social scientists say, or they can realize the truth.

Once breached by rejection, separation and divorce, a family is not a family at all – especially outside of a committed relationship. That a single mother and her child is a real family is also debatable. The “wise men” of the nation have simply continued to revise the definition of the family to suit their needs. That is the deeper reality that the state would have you ignore to your continued peril. It benefits them for you to believe as you do.

It has been posited that the “Founding Fathers” would turn over in their graves if they were able to know about the ongoing debt slavery and legalized human trafficking that is the United States. I think not. These men were fully aware of the hypocrisy that “America” was built on. The governance of the nation has profited from the slavery and oppression of others from the very beginning with little apology, or admission of error. The lawgivers have even reconfigured the corporation to enslave for personal advantage. Robber barons everywhere continue the public plunder under the pretense of propriety and a kind face when it suits them. Your consent is your ignorance. Even governance is just another corporation. They seduce “the people” with infrastructure and social trinkets. The propaganda machine has continued to eject that notion that the nation is a democracy, the “land of the free.” Who the “free” truly are is for you to decide.

The Disconnect On How Child Support Laws Are Viewed & How They Work

child support formulasThe public views court-ordered formulas calculating child support in the United States and England to be unfair, according to a study released Monday. Articles proclaim that researchers hope that this will be valuable information for policymakers dealing with family law issues. Existing child support law is not consistent with the basic application of fairness that most people have.

Here’s the kicker. The research ultimately found that the public believes child support should be adjusted higher or lower based on the mother’s income (assuming she is the custodial parent caring for the children). If you take this statement alone and at face value, the danger and disconnect here seems to be that the income of the father is ignored. Hm-m.

In some states, child support is based solely on the noncustodial parent’s income, while in others both incomes are used in the calculation with an emphasis on the noncustodial parent’s income. Each state has a set formula for judges to use in child support cases.

justice and moneyThis study used face-to-face questions and feelings about certain courtroom scenarios. Respondents were found to be three times as responsive than the law when it came to adjusting child support based on income changes of the noncustodial parent. In one hypothetical scenario, if the noncustodial parent made less than a custodial parent, the amount of child support would be lowered, by $100. In that case, the respondents reported they would actually lower the amount by $300. Judges have grown to be jaded and unfair.

The study also found that once a father was ordered to pay a certain amount, that percentage of his income should remain the same even if his income increased or decreased.

The law doesn’t pay any attention to remarriage of the custodial parent, but respondents wanted to take into account the stepparent’s income. This is also a dangerous precedent, allowing for more ravaging of real families by the state. This begins to tell me that a fair percentage of participants in this study were sympathetic, yet disconnected from the damage that child support is already doing to families.

Non-custodial parents have become targets for a state-operated racketeering and extortion operation. Increasingly, the state is proving to be the mafia, even though most of us have become conditioned to this. Is that an insane statement? Hardly. It becomes apparent when you are the target.

dad-slavery-2Child support is routinely established at levels higher than the noncustodial parent can pay. Child support is determined by judges who refer to an income table and set of guidelines. Judges do have the authority to depart from those guidelines and modify amounts depending on certain circumstances, but they must justify in writing why a case needs different treatment. This may, or may not be a problem. Yet, the difficulty of modifying court-ordered child support in situations where non-custodial parents have lost their job or had a pay cut is another shortcoming of the current system. Fear is designed to be the continued motivation for the non-custodial parent.

What the study found to be unique was that respondents agreed across many boundaries. “You get that same result no matter what — if it’s about women and men, there’s no difference. High-income people and low-income people are the same, same pattern. If they’re Democrats and Republicans, no difference,” said Ira Ellman, an author of the study and professor of psychology and law at Arizona State University. “You get this result over and over again, it’s true in the U.K. also, so that’s a powerful result, I think.”

Owe Money? You’re A Deadbeat

They want you shaking in your boots. If you owe child support in the United States, authority claims you are a “deadbeat.” People owe money for all kinds of debts, but that doesn’t make the person a deadbeat, nor are they called one. In fact, the current Administration wants you in debt to grow the economy, but most “deadbeat” parents with an average or less income don’t have any money to spend to support the dreams of the state. In fact, they don’t even have the mythology of the “American Dream” that American Presidents push like candy. They are too busy supporting the state and Federal government to prop up unconstitutional child support. It’s all about “justice” they say.

For example:

Early Wednesday morning, a group of Montgomery County sheriff’s deputies went around the county seeking “deadbeat” parents who have failed to appear in court for failing to pay child support. The nine parents taken into custody owe a total of $66,382.90 to nine children.

violation of due process and civil rightsIn fact, as far as these authorities are concerned, you owe them money. That is because according to Federal Law, you do owe the state. Child Support is federal debt per the Bradley Amendment for Social Security Administration. The Federal government pays the state corporations handsomely for collecting what debt they can, all backed and funded by federal taxpayer funds. It’s Constitutionally illegal, but justified by fed and state alike (as statute or policy) as they work together to pry money from “deadbeats” any way they can. The Feds may be financially bankrupt themselves, but you won’t have that privilege, if and when you decide to file bankruptcy. That is because President Bush signed eternal child support into law by modifying bankruptcy code. The state has all the rights. There is no way out in their eyes… you know, the death and taxes sort of thing. That is the sad path that this nation has taken – the path of exploitation, extortion and tyranny.

criminal conductIn this day, depending on the local authority around you, the sheriff is seeking to shame anyone that is behind on child support for any reason. They post your name, address and face on a billboard or online with your local newspaper. To authorities, your debt of child support is a public issue that is all your fault. The reality is entirely different. The state persecutes you because of corporate policy. You see, each court, each government department is a corporation that seeks to make money off of you. Many of them have decided that you will be cuffed and slapped in jail, with the expectation of coercing you to pay up your child support. The court doesn’t even need to be right. Much of the time, the ‘judge’ isn’t right – not even close.

kangaroo courtActually, these “family courts” are wrong 100% of the time. American ‘citizens’ are supposed to have Constitutional guarantees that preclude evil treatment by the authority of courts, family judges and those that take their orders from them. Due process has become fiction. Most attorneys are fearful of standing up for real justice. That justice certainly isn’t oppressing non-custodial parents, even if they are ‘guilty’ before the law (that means what they want it to mean). For that matter, human rights have become fiction too – even as the Feds point a finger of accusation at China or Russia. The Feds have made themselves the holy arbiter of ‘human rights,’ the church of morality. In the case of any court-ordered child support, your human right is for you to pay up and shut up. That is called tyranny.

Everyone is affected. Nobody is immune. They just think they are – immune that is. The only vaccination is to overthrow the tyranny.

“Obama Care, Disability & Child Support”: Time to Rare Up America

It’s long overdue to do something useful. Americans sit like a stack of toads as their personal Constitutional rights are stripped away from them. In a time of unprecedented national and financial crisis, the federal and state governments work diligently to concoct kangaroo courts in the name of collecting child support from indigent and jobless members of society. It’s extortion of the populace on a grand scale to support an out of control element of American society in the name of child worship and responsibility.

If you have managed to live through life-changing illness into the land of disability, you are a target ripe for plucking and harassment. You are likely to lose your license if you still have managed to keep a car and you won’t be able to get to the doctor to take care of yourself, unless you have someone to help you. Friend, that better be because you need friends, real ones.

Once a little government disability cash starts to roll, if you owe on a school loan, the U.S. Treasury will be after your butt post-haste. It wasn’t enough for a judge to certify you as disabled, and never mind that the government has all records they need to show a scant touch of mercy without continuing to put you through hell. Then again, if you are disabled, you can take matters into your own hands and have your doctor sign off on your life changing condition, thus nullifying the callous efforts of the Education Department. If you find yourself in this space of life, you’d better get moving while you can since they are likely to close any loophole that could benefit the poor, oppressed and indigent in America. Get started.

That still doesn’t solve the problem with the kangaroo courts, who are happy to try you in your absence, since you probably can’t get to court. Even if you could, you are destined for a shellacking. They hold all the cards. It’s called lawful extortion, more of what nations, kings and governments have been doing throughout history because they have the authority to do as they please. You, Mr. and Mrs. America, are slaves, serfs to that reality. Let’s face it. The land of free and home of the brave is no different from any dictator element of any third world oppressor. The American kangaroo court system that claims to worship children flies in the face any ideal for human rights. They pretend that they are legislating morality and honor, while none exists.

That is the nation that we live in. What are going to do about it? Can you pick up a pen and write a corrupt Congress? Sure you can! Make them feel your wrath while you still have the freedom to do so! Can you stop multitudes of cheap whores from taking down hard-working Americans that deserve better? (Yes, a whoredom has little to do with sex, it’s a lifestyle, a way of life!) Of course, you can!

Remember that making men responsible for children is big business. Making women responsible is far less profitable. The political pay back for “responsibility” is huge except that the very people preaching are beyond moral bankruptcy. It’s Elmer Gantry preaching to the simpleton hordes. But you have to decide to do something outside of sitting around in a heap and feeling sorry for yourself.

Tough times call for tough solutions. Congress and the new America need to be in their rightful place or you and every man, woman and child will forever be enslaved to a system that is out of control, with only itself to feed. The nation is on a path to self-destruction as it decimates families and supports bad attitudes. The system does nothing for children except to make them less than what are. Shame on the United States!

Fox Network zeroes in on ‘Bad Dads’

After embracing the dark side of reality television with its marriage-busting hit “The Moment of Truth,” Fox’s newest project taps the power of its unscripted division for the forces of good.

The network has ordered a pilot from 3Ball Productions, in which an avenger of penniless single mothers hunts down deadbeat dads and forces them to pay child support.

Jim Durham, director of the National Child Support Center, functions as a sort of “Dog the Bounty Hunter” for tracking deadbeats. In the pilot, a financially destitute mom is contrasted with her wealthy ex-husband, who is living the high life. Durham confronts the man at his country club to shake him down in front his friends. It’s ambush reality TV — but for a noble cause.

“(Durham) calls them on the phone and gives them the chance to do the right thing,” said executive producer JD Roth (“The Biggest Loser,” “Beauty and the Geek”). “Of course, those calls are never met with anything but yelling. Then he goes into their life, finds out what kind of assets they have and makes their lives miserable — foreclose on their house, repossess their car. He will squeeze them until the women get paid.”

Roth sold the idea to Fox with the title “Deadbeat Dads.” But Fox president of alternative entertainment Mike Darnell famously concocts his own catchy titles for his shows. (“Nothing but the Truth” became “The Moment of Truth,” and “Do You Remember 5th Grade?” morphed into “Are You Smarter Than a 5th Grader?”) Darnell has rechristened “Deadbeat Dads” with the very-Fox working title “Bad Dads.”

Sluggish government agencies often fail to persuade financially liable fathers to pay child support. As of 2006, the nation’s cumulative uncollected child support stood at about $105 billion, according to U.S. Department of Health & Human Services. Last year’s federal budget cuts could make the problem even worse, potentially adding about $11 billion in uncollected child support over the next 10 years.

Durham’s National Child Support Center is one of several collection agencies that serve as a last resort for neglected single mothers. Some critics say such companies do more harm than good. Child support collectors have been accused of charging steep fees and using ultra-aggressive tactics. Durham bills his clients 34% of whatever he collects.

Roth counters that Durham’s clients typically feel so abandoned by the court system that they’re relieved to get any money at all. Plus, he said Durham is the only collector who extracts interest owed on the outstanding debt, so his clients often receive more money than if the absent dads had simply paid their bills.

As for the aggressive tactics, child support is not considered a debt per se, but an order of the court. Collectors are therefore not subject to following the Fair Debt Collection Practices Act, which regulates what tactics a collection agency can employ to collect a debt.

“I’m hoping that eventually this show changes how courts see deadbeat dads and how moms have to deal with it,” Roth said.

If greenlighted to series, “Bad Dads” will provide Fox a fresh take on the law enforcement reality show, a genre the network pioneered with such Saturday night staples as “Cops” and “America’s Most Wanted.”

“I’ve seen ‘Cops,’ and I want to watch more than a crack addict with his pants around his ankles running away from a police car,” Roth said. “These guys owe money, and they should pay.”
